About these terms

These Terms and Conditions (“Terms”) apply to your use of this website, which is owned and run by Gingerair Innovations Private Limited (“Gingerair”, “we”, “us” or “our”), a company incorporated in India. gair is a brand of Gingerair.

By using this website, you agree to these Terms, our Privacy Policy, our Return Policy and our Refund Policy. If you don’t agree, please don’t use the website.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not need a physical or digital signature.

How buying works

This website shows our products, their features, prices and availability. It does not take orders or payments.

• Buy Now takes you to the Gingerair marketplace (gingerair.in/marketplace). Your order, payment and delivery there are governed by the marketplace’s own terms, together with our Return and Refund policies for gair products.
• Buy via WhatsApp opens a chat with our team. We will confirm the product, price, delivery details and payment method with you before your order is placed. An order is confirmed only when we confirm it to you in writing.

We may decline or cancel an order, for example if a product is out of stock, a price was shown incorrectly, or we suspect fraud. If you have already paid for an order we cancel, we will refund you in full.

Prices and product information

• Prices are in Indian Rupees (₹). The price that applies to your order is the one confirmed on the marketplace or by our team at the time of ordering.
• We try to keep prices, stock and product details accurate and up to date, but errors can happen. If we find an error affecting your order, we’ll tell you and you can choose to continue or cancel.
• Product images are for illustration. Colours may look slightly different on your screen, and accessories shown in lifestyle photos (such as bags, keys or phones) are not included unless we say so.
• Battery life, range and other figures are typical values measured in normal conditions. Your results may vary with use, settings and environment.

Using our products safely

gair Fitness Band

The gair Fitness Band is a consumer wellness product. It is not a medical device and is not meant to diagnose, treat, cure or prevent any disease or condition. Readings such as heart rate, SpO₂ and sleep are estimates for general fitness and wellness. Always talk to a doctor about your health, and don’t change any treatment based on the band’s readings.

gair Luggage Trackers

• gair trackers use Bluetooth and the location networks of compatible phones (such as Apple Find My or Android Find Hub, depending on the version). They are not GPS trackers, and location updates depend on nearby compatible devices, network coverage and your phone’s settings. We can’t guarantee that a lost item will be found.
• Use trackers only on belongings you own or have permission to track. Using a tracker to follow or monitor a person without their knowledge and consent is prohibited and may be a crime under Indian law.
• Keep trackers, small parts and coin batteries away from children and pets. Swallowing a battery can cause serious injury.
• Follow airline and travel rules when carrying trackers in luggage.

Using this website

You agree not to:

• use the website for anything unlawful, misleading or harmful;
• send false, abusive or spam enquiries, or pretend to be someone else;
• try to break, overload, scrape or gain unauthorised access to the website or its systems;
• copy or reuse our content in a way these Terms don’t allow.

We may restrict access to the website if we believe these Terms have been broken.

gair Seller Programme

Applying to the gair Seller Programme does not create a partnership, distribution or reseller agreement. We review every application and may accept or decline it at our discretion. If we accept, the terms of our business relationship will be agreed separately in writing.

Intellectual property

The gair name, logo and monogram, and the text, photos, graphics and design of this website, belong to Gingerair or its licensors and are protected by law. You may view and share pages for personal, non-commercial use. You may not copy, modify or use our brand or content for any other purpose without our written permission.

Apple, iPhone and Find My are trademarks of Apple Inc. Android and Find Hub are trademarks of Google LLC. Other names mentioned on this website belong to their respective owners. Mentioning them describes compatibility only and does not mean they endorse gair.

Links to other websites

The website links to other websites and apps, including the Gingerair marketplace, WhatsApp and social media. We aren’t responsible for their content or practices, and their own terms apply when you use them.

Warranty and liability

Your rights under the Consumer Protection Act, 2019 and other applicable laws are not affected by these Terms.

The website is provided “as is”. To the extent permitted by law, we do not promise that it will always be available, error-free or free of viruses.

To the extent permitted by law, Gingerair is not liable for any indirect or consequential loss arising from your use of the website or our products, or for any loss of items you track with a gair tracker. Our total liability for any claim relating to a product is limited to the price you paid for that product.

Indemnity

You agree to compensate Gingerair for losses or claims that arise because you broke these Terms or misused the website or our products, to the extent permitted by law.

Governing law and disputes

These Terms are governed by the laws of India. If a dispute comes up, please contact us first, as most issues can be solved quickly. If we can’t resolve it, the courts at the city of our registered office will have jurisdiction, without affecting your right to approach a consumer commission under the Consumer Protection Act, 2019.

Grievances

If you have a complaint about the website or our products, contact our Grievance Officer: (Grievance Officer name), email (grievance email). We will acknowledge your complaint within 48 hours and work to resolve it within one month.

Changes to these terms

We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. Using the website after a change means you accept the updated Terms.
